A Process of Building Role Model of Community-Based Paralegals For Building Peaceful Sub-district : A Case Study of Sawai Sub-district, Prangkhu District, Sri Sa Ket Province

Abstract

 

The research on “A Process of Building Role Model of Community-Based Paralegals For Building Peaceful Sub-district : A Case Study of Sawai Sub-district, Prangkhu District, Sri Sa Ket Province” has objectives which are 1) to study the contents and law condition implementation for promoting peaceful sub-district of Sawai Sub-district, Prangkhu District, Sri Sa Ket Province, 2) to study principles, concepts, theories in the Building Role Model of Community-Based Paralegals in the modern science and Theravada Buddhism, and 3) to present the process in Building Role Model of Community-Based Paralegals For Building Peaceful Sub-district for promoting peaceful sub-district of Sawai Sub-district, Prangkhu District, Sri Sa Ket Province. This is a qualitative research by collecting the data from the documentary research, in-depth interview from 20 community leaders and from the focus group of 8 experts. The research methodology used is focus group and interview form with The data analysis is done by content analyzing and summarized into item numbers.

              The research results revealed that

              1. From the content study and law condition implementation in Sawai Sub-district, it was found that 1) there is a conflict issue in terms of law, 2) villagers were deceived to loan an informal debt, 3) villagers were taken advantage with the illegal interest charges, 4) the tile deeds of villagers were registered for mortgage as a bank loan security, 5) issue on outlaw land, ALRO land, public land trespassing, right of land notice, selling and transferring ALRO land by heritage, 6) issue on inheritance with no testament, 7) issue on trespassing the other’s land, 8) issue on cow and buffalo trespassing the land territory of others, 9) issue on the drug in community, and 10) dishonest corruption, etc.

              2. The results by studying from the principles, concepts, theories in the Building Role Model of Community-Based Paralegals in the modern science and Theravada Buddhism were as follows:

                  2.1 The modern science concept had principles and concepts about the Building Role Model of Community-Based Paralegals that 1) the concept of conformity, 2) the concept of community justice, 3) the concept of skills in law implementation, 4) the concept of conflict resolution in the community, 5) the concept of dispute mediation, 6) the concept of volunteer and public mind, and 7) the principle in human development by universal principle which were Vision, Education, Training, and Educational Field Trip.

                 2.2 In the concept of Theravada Buddhism had principles and concepts about the development of law officers that 1) In the Buddha time, it was found that there was an appointment of Phra Vinayathorn in order to solve the problem or settle a legal question, and use the 7 Adhikarana Samathas which were (1) Sammukha Vinaya, Settling a conflict by confrontation; (2) Sati Vinaya, Settling a conflict by taking into account the mindfulness; (3) Amulhavinaya, Settling a conflict by taking into account the insanity; (4) Patinnata Karana, Settling a conflict after an admission; (5) Tassapapiyasika Kamma, Settling a conflict for those who deny their faults; (6) Yebhuyyasika Kamma, Settling a conflict by a majority decision; (7) Tinavattharaka Kamma, Settling a conflict covering the act with grass (reconciliation). 2) The dhamma principles for the Role Model of Community-Based Paralegals were the Threefold Trainings (Trisikkha), the Four Sublime States of Mind (Brahmavihara 4), the Four Principles of Service (Sangahavatthu 4), the Four Development (Bhavana 4), the Four Paths of Accomplishment (Iddhipada 4), and the Seven Qualities of A Good Man (Sappurisa-dhamma 7).

              3. A Process of Building Role Model of Community-Based Paralegals For Building Peaceful Sub-district at Sawai Sub-district, Prangkhu District, Sri Sa Ket Province which were:

                 1) Peaceful development voluntary activist should acquire volunteer and sacrifice mind which were 1) volunteer, 2) loving-kindness and compassion, 3) morality, and 4) inner peace.

                 2) Healing harmonizer was a mental healer who acquired 1) united vision, 2) communication knowhow, 3) reciprocal supporter, 4) interdependence.

                   3) Dispute reconciliatory mediator should acquire laws, regulations, and skills consisting of 1) peace skill, 2) speaking and listening skill, 3) reconciliation skill, 4) recording skill.

                 4) Lawyers should understand laws and functions of living together, understand the social regulations and mechanics consisting of 1) know the community content, 2) know the fundamental laws for community, 3) love and harmonize in the community, and 4) know the peace.

              4. The process in developing the community legal officer model for promoting peaceful sub-district of Sawai Sub-district, Prangkhu District, Sri Sa Ket Province had stages which were 1) preparation stage/determine the training program for community legal officer model, 2) training stage, 3) practical stage by using the dispute reconciliation techniques, 4) stage for skill training in dispute reconciliation, 5) evaluation stage on the training outcome before and after the training. It was found that before the training, the participants had knowledge and understanding at the moderate level but after the training, the participants had knowledge and understanding at high level. In overall aspects, it was found that the participants showed a high level of satisfaction, 6) implementing stage from the training in 3 dispute reconciliations which were (1) a case of dispute between a creditor and a debtor, (2) a case of borrowing the title deed for security, and (3) a case of asset distribution.
